{"id":2335,"date":"2016-02-18T16:12:38","date_gmt":"2016-02-18T08:12:38","guid":{"rendered":"http:\/\/primer.com.ph\/tips-guides\/?p=2335"},"modified":"2021-07-01T10:05:21","modified_gmt":"2021-07-01T02:05:21","slug":"annulment-in-the-philippines","status":"publish","type":"post","link":"https:\/\/primer.com.ph\/tips-guides\/2016\/02\/18\/annulment-in-the-philippines\/","title":{"rendered":"Annulment in the Philippines"},"content":{"rendered":"<p><span style=\"font-size: 12pt\">In the Philippines, <a href=\"https:\/\/primer.com.ph\/tips-guides\/2016\/02\/17\/expat-guide-no-divorce-in-the-philippines\/\" target=\"_blank\" rel=\"noopener\">Divorce is not an option<\/a> for couples who want to legally end their marriage, and considerably the closest thing to it would be <a href=\"https:\/\/en.wikipedia.org\/wiki\/Annulment\" target=\"_blank\" rel=\"noopener\">Annulment<\/a> and <a href=\"https:\/\/en.wikipedia.org\/wiki\/Legal_separation\" target=\"_blank\" rel=\"noopener\">Legal Separation<\/a>. <\/span><\/p>\n<p>&nbsp;<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-2338\" src=\"https:\/\/primer.com.ph\/tips-guides\/wp-content\/uploads\/sites\/5\/2016\/02\/Walang-Forever.jpg\" alt=\"Walang Forever\" width=\"850\" height=\"650\" \/><\/p>\n<p><span style=\"font-size: 12pt\">\u00a0<\/span><\/p>\n<p><span style=\"font-size: 12pt\">One thing you should know is that the process for Annulment is usually laborious, expensive, and time-consuming in this country. You get a lawyer \u2013 a good one at that. You file for a petition for legal separation. You show up in court, and convince the judge and the people in the courtroom why you think you cannot make the marriage work out. It is a tedious task which is why some people opt for just living together with their partner, rather than getting married in a church or by a judge. But if you are in a situation where Annulment is your final option, here are some things you need to remember.<\/span><\/p>\n<p><span style=\"font-size: 12pt\"><strong>1. Six (6) legal grounds for Annulment<\/strong> <em>(See <a href=\"http:\/\/www.chanrobles.com\/executiveorderno209.htm#.VsVqgdAl5ei\" target=\"_blank\" rel=\"noopener\">Family Code Art. 45<\/a>)<\/em><br \/>\n<\/span><\/p>\n<p style=\"padding-left: 30px\"><span style=\"font-size: 12pt\">\u2022 Lack of parental consent (if either legal party is at least 18 but below 21)<\/span><\/p>\n<p style=\"padding-left: 30px\"><span style=\"font-size: 12pt\">\u2022\u00a0 Psychological incapacity<\/span><\/p>\n<p style=\"padding-left: 30px\"><span style=\"font-size: 12pt\">\u2022 Fraud<\/span><\/p>\n<p style=\"padding-left: 30px\"><span style=\"font-size: 12pt\">\u2022 Consent for marriage obtained by force, intimidation, or under the influence<\/span><\/p>\n<p style=\"padding-left: 30px\"><span style=\"font-size: 12pt\">\u2022 Impotence or physical incapability of consummating the marriage<\/span><\/p>\n<p style=\"padding-left: 30px\"><span style=\"font-size: 12pt\">\u2022 Serious sexually transmitted disease<\/span><\/p>\n<p style=\"padding-left: 30px\"><span style=\"font-size: 12pt\">\u2022 Among the grounds listed above, the most commonly used reason is Psychological Incapacity.<\/span><\/p>\n<p><strong><span style=\"font-size: 12pt\">2. The Fees<\/span><\/strong><\/p>\n<p style=\"padding-left: 30px\"><span style=\"font-size: 12pt\">\u2022 Filing Fee: P10,000 or less \u2013 This is the first thing that you have to do: file for a Petition for Annulment of Marriage before the Executive Clerk of the Court RTC or Regional Trial Court of the city or province you have lived in for at least 6 months. Filing fees may be cheaper if you don\u2019t have too much conjugal property to negotiate for.<\/span><\/p>\n<p style=\"padding-left: 30px\"><span style=\"font-size: 12pt\">\u2022 Acceptance Fee: 100,000 Php or more. Basically, this is for your lawyer or the firm your lawyer is under. It\u2019s a fee for them accepting your case in the first place.<\/span><\/p>\n<p style=\"padding-left: 30px\"><span style=\"font-size: 12pt\">\u2022 Pleading Fee: May range from 5,000 Php to P10,000 Php each. Pleadings are the documents you need to submit in court such as petitions and affidavits.<\/span><\/p>\n<p style=\"padding-left: 30px\"><span style=\"font-size: 12pt\">\u2022 Appearance Fee: May range from 5,000 Php to 10,000 Php each. This is used when your lawyer actually goes to court for a scheduled hearing.<\/span><\/p>\n<p style=\"padding-left: 30px\"><span style=\"font-size: 12pt\">\u2022 If your ground is Psychological Incapacity, you will need a psychological report and your doctor\u2019s appearance on court for proof that you are indeed psychologically incapacitated.<\/span><\/p>\n<p><span style=\"font-size: 12pt\">However, the fees don\u2019t end here \u2013 there are still other things which are needed to be paid for, like records, notarization, publication, and such. A budget may range from 165,000 Php \u2013 200,000 Php or more, with the psychological report included.<\/span><\/p>\n<p><strong><span style=\"font-size: 12pt\">3. The Wait<\/span><\/strong><\/p>\n<p><span style=\"font-size: 12pt\">The waiting of the result of your petition usually varies for each city. It may take 2 years in Caloocan, Makati, Pasay, and Pasig and about 3 \u2013 5 years in Quezon City. But, these numbers are just rough estimates because the longer the case goes on, the more expensive it gets.<\/span><\/p>\n<p><span style=\"font-size: 12pt\">The law is complicated to those who don\u2019t fully understand the judicial system but it doesn\u2019t hurt to get a little help or advice from your lawyers.
